Terms of Service

These Terms of Service ("Terms") are an agreement between you and Sleepy Moon LLC ("Sleepy Moon," "we," "our," or "us"). They cover your use of the Sleepy Moon mobile application and the website sleepymoon.app (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
1. Who Can Use Sleepy Moon
You must be at least 18 years old, or the age of majority where you live, to create an account. Sleepy Moon is made for parents, grandparents, and other trusted adults. Children do not have accounts and should not use the app on their own. They may listen to recordings with a parent or legal guardian, who manages the family and is responsible for that use.
2. Your Account and Your Family
- You are responsible for your account, for keeping your sign-in secure, and for everything that happens under your account.
- A family is created by an owner, who can invite other members with an invite link or code. Invite only people you trust. Anyone you invite can hear and view the recordings and messages shared in that family.
- Family owners can remove members. You can leave a family at any time.
- Please give accurate information and keep it up to date.
3. Your Recordings and Messages
You keep ownership of the audio, video, photos, captions, and messages you create ("Your Content"). To run the Service, you give us a limited, worldwide, non-exclusive, royalty-free license to store, copy, process, and transmit Your Content only as needed to provide the Service to you and the family members you share it with. This includes making backups, preparing media for playback, and creating captions or transcripts when you use those features. This license ends when Your Content is deleted from the Service, except for copies kept for a limited time in backups or where the law requires us to keep them.
You are responsible for Your Content. You confirm that you have the rights needed to record and share it, and that it does not violate anyone else's rights or any law.
4. Acceptable Use
When using Sleepy Moon, you agree not to:
- Share content that is illegal, sexually explicit, hateful, harassing, violent, or harmful to children.
- Share content that infringes someone else's copyright, trademark, privacy, or other rights.
- Impersonate another person, or join a family you were not invited to.
- Interfere with, disrupt, reverse engineer, or try to gain unauthorized access to the Service or its systems.
- Use the Service to send spam, advertising, or other commercial messages.
We may remove content or suspend accounts that break these rules. If you see something that should not be on Sleepy Moon, please tell us at [email protected].
5. Discover Catalog
The Discover section offers stories, lullabies, and other recordings made available by Sleepy Moon and its partners ("Catalog Content"). Catalog Content is licensed to you for personal, non-commercial listening within the Service. You may not copy, download outside the app, redistribute, or publicly perform Catalog Content. Some Catalog Content may require a subscription or purchase, and availability may change over time.
6. Publishing
We plan to let authors, narrators, and musicians publish recordings for families beyond their own. Publishing is not available yet. When it launches, additional publisher terms will apply, including rules for public content, review, and removal. We will ask you to accept those terms before you publish anything.
7. Subscriptions and Purchases
Sleepy Moon offers a free plan and paid plans, currently Family and Super Sponsor. Plan features and prices are shown in the app before you buy.
- Billing: Purchases are made through the Apple App Store or Google Play and are charged to your Apple ID or Google account when you confirm the purchase.
- Automatic renewal: Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends.
- Managing and canceling: You can manage or cancel your subscription in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
- Free trials: If a free trial is offered, any unused part of the trial ends when you buy a subscription.
- Refunds: Refunds are handled by Apple or Google under their policies. We cannot issue refunds for store purchases directly.
- Family coverage: A paid plan covers the family or families described in the app. If a subscription ends or is canceled, the families it covered return to the free plan, and paid features such as cloud sync stop working.
- Price changes: We may change prices. The store will notify you in advance as its rules require, and you can cancel before a new price takes effect.
8. Apple and Google
These Terms are between you and Sleepy Moon LLC, not Apple Inc. or Google LLC. Apple and Google are not responsible for the Service or its content, and have no obligation to provide maintenance or support for it. If the Service fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the Service. Sleepy Moon, not Apple, is responsible for addressing any claims relating to the Service, including product liability claims, claims that the Service fails to meet legal or regulatory requirements, consumer protection claims, and claims that the Service infringes someone's intellectual property. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.
9. Our Service
The Sleepy Moon app, website, design, and software belong to Sleepy Moon LLC and are protected by law. We give you a personal, non-transferable, revocable license to use the app on devices you own or control, following these Terms and the rules of the store you downloaded it from. We may update, change, or stop offering features of the Service. We will try to give you reasonable notice of changes that significantly affect you.
10. Ending Your Use
You can stop using the Service and ask us to delete your account at any time by contacting [email protected]. We may suspend or end your access if you break these Terms or if we need to for legal reasons. When an account is deleted, Your Content is removed as described in our Privacy Policy. Recordings you shared may no longer be available to your family.
11. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will always be available, error-free, or that recordings will never be lost. Please keep your own copies of recordings that matter to you.
12. Limitation of Liability
To the fullest extent the law allows, Sleepy Moon LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, content, or profits, arising from your use of the Service. Our total liability for any claim related to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or 50 U.S. dollars. Some places do not allow these limits, so they may not fully apply to you.
13. Indemnity
You agree to defend and hold harmless Sleepy Moon LLC from claims, losses, and expenses, including reasonable legal fees, that arise from Your Content or from your breaking these Terms.
14. Governing Law
These Terms are governed by the laws of the State of Idaho and applicable federal laws of the United States, without regard to conflict of law rules. Nothing in these Terms takes away rights you have under the consumer protection laws of the place where you live.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the new Terms on this page and update the effective date. If the changes are significant, we will let you know in the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
